Summary of updates to our Terms of Service

At Addressfinder, we regularly review and update our Terms of Service to reflect improvements in our services, simplify our policies, and ensure compliance with evolving legal and privacy requirements. The latest update, effective 24 September 2025, reflects several meaningful changes designed to provide greater clarity, value, and alignment with how our services are delivered.

Why we're updating our Terms of Service

We have moved our billing system to Stripe to improve the subscription and billing experience for our customers. The majority of the terms updates, effective 24 September 2025, reflect the move to Stripe and the improvements this billing system provides.

  • Payment processing: We have upgraded our billing system to Stripe to further enhance customer experience and billing security.
  • User simplicity: We've removed complexity in how plans, upgrades, and downgrades are defined and handled.
  • Product and website improvements: Updates reflect our new service URLs and digital infrastructure changes.
  • Contracting entity updates: We've revised how our terms apply to users in different countries to better reflect our operations and legal responsibilities.

Summary of key changes and enhancements

Note that this is a summary of some of the main changes, it is not an exhaustive list.

Plan changes

  • Renewal dates have changed:
    • For new subscriptions: based on the subscription start date.
    • For existing customers (before 24 September 2025): first day of the month.
  • Definitions for plan "Upgrade" and "Downgrade" are now categorised by plan price.
  • Trial plan limits now apply per trial period, not per calendar month.
  • The Free Plan is now marked as deprecated.

Simplified subscription plan logic

  • Annual Plan exceeding lookups:
    • The start date for a new plan upon exceeding lookups for annual plans is now the "date your plan is renewed," rather than the day immediately following the date you first exceed the permitted number of lookups.
    • Addressfinder now has the discretion to change an annual plan to an "Upgrade or Downgrade" based on usage history for better value, rather than strictly renewing onto a Replacement Plan.
  • Upgrade logic simplification:
    • For Trial, Free, and Monthly paid plans, upgrades now take effect immediately on the date of upgrade.
    • For annual plans, upgrades take effect on the first day following the end of the current plan or on the day lookups are exceeded, whichever comes first. This is a more streamlined approach compared to the previous varied rules.
  • Downgrade logic clarification:
    • For monthly paid plans, downgrades take effect on the first day following the end of your current plan.
    • For annual plans, downgrades take effect on the first day following the end of your current plan or on the day lookups are exceeded, whichever comes first.

Contracting entity by residency

  • The contracting entities have been reversed for residency outside of Australia or New Zealand.
    • Previously, if you resided in Australia, you contracted with Addressfinder Australia; if you resided anywhere else, you contracted with Addressfinder New Zealand.
    • Now, if you reside in New Zealand, you contract with Addressfinder New Zealand; if you reside anywhere else in the world, you contract with Addressfinder Australia. This change is consistently reflected in the "Our Related Parties" definitions.
  • Governing law and jurisdiction now aligns with your country of residence:
    • NZ residents: governed by New Zealand law.
    • All others: governed by New South Wales, Australia law.
  • Clarified that this does not affect any statutory rights under applicable data laws.

Invoice payment terms

  • Invoices are now payable within 20 days of receipt, instead of by the 20th of the following month to reflect changes in dynamic plan start dates.

Website and service URL

  • The definition of a "Lookup" now includes services like email and phone verification or data enrichment - providing more transparency around usage.

What you need to do

No immediate action is required unless you wish to review your subscription settings or plan. These updates are effective from 24 September 2025, and continued use of our services indicates your acceptance of the new terms.
